CONSUMER HEALTH DATA POLICY

Protecting your health data
We’re committed to keeping your health information safe, private, and in your control.

This Consumer Health Data Policy (“Policy”) supplements Weller & Co.’s Privacy and Cookies Policy and explains our practices for “Consumer Health Data” in accordance with U.S. Health Privacy Laws, including but not limited to Washington’s My Health My Data Act, Nevada’s Consumer Health Data Privacy Law, and Connecticut’s Data Privacy Act.

For explanations of legal or technical terms referenced herein, please consult the Key Definitions section of our Privacy and Cookies Policy.

  • “Consumer Health Data” is broadly defined as personal information that is linked or reasonably linkable to a consumer and that identifies past, present, or future physical or mental health status.

    This includes information about medical conditions, biometric data, and the use of health-related products or services.

    It also covers any data used to infer or predict health-related attributes—even if not explicitly collected for health purposes—including data from AI-based product matching systems, behavioral tracking, wellness questionnaires, and health-related content shared by scientific contributors that includes individual-level case data, even if de-identified.

    Weller & Co. requires all contributors to comply with applicable data privacy laws, including adherence to HIPAA de-identification standards where relevant.

    This policy also applies to health-related personal data that may be voluntarily uploaded by suppliers, customers, or third parties through informational forms or other document upload features on our Site. Weller & Co. does not require submission of such data but processes it with the same level of protection and compliance as other Consumer Health Data when it is present.

    Note: This policy does not apply to data collected in an employment context.

  • We collect this data from:

    • Directly from you – e.g., survey responses, product requests, or app usage

    • Your interactions with us – e.g., browsing our health-related sites

    • Business and marketing partners – e.g., affiliate sites, loyalty programs

    • Third-party data sources – e.g., data brokers or social media platforms

    • Derived inferences – e.g., behavior patterns inferred from other collected data

  • Weller & Co. may collect the following types of Consumer Health Data:

    • Product Interests – Health-related product and brand interactions (e.g., visits to our websites or purchases).
    • Health Conditions and Treatments – Voluntarily provided information on symptoms or conditions (e.g., allergies, colds, pregnancy).
    • Bodily Function and Vital Signs – Metrics such as metabolism, digestion, or biometric measurements.
    • Reproductive and Sexual Health – Data such as period tracking or pregnancy status, if voluntarily shared.
    • Biometric Data – Information generated from facial, skin, or other physical characteristics for product recommendations.
    • Genetic Information – Limited to research participation with appropriate consents.
    • Research Programs – Health-related information collected through surveys or studies.
    • Uploaded Documents – Such as procurement forms, certifications, or resumes submitted by users that include health-related information.

  • We use Consumer Health Data only as necessary to provide our services and as permitted by law.
    Our uses include:

    • Fulfilling product or sample requests
    • Managing consumer accounts and preferences
    • Responding to service requests and communications
    • Processing payments for purchases
    • Administering loyalty programs, contests, or rewards
    • Serving and optimizing targeted ads (where permitted)
    • Conducting quality control, security, and fraud prevention
    • Maintaining records and fulfilling legal obligations
    • Conducting research and product development
    • Supporting AI-driven product recommendations and personalization using health-related inputs and behavioral signals

  • Weller & Co. does not sell your Consumer Health Data. We may share this data with:

    • Service providers and processors acting on our behalf
    • Other Weller & Co. brands bound by our Privacy Policy
    • Legal entities when required by law or for compliance, safety, or acquisition-related matters

    We will never share this data without proper contractual safeguards and/or your consent where required.
    Where permitted by law, we may share de-identified or aggregated Consumer Health Data with academic institutions or research partners for purposes such as product efficacy validation or health trend analysis.
    All data sharing is governed by written contracts that require recipients to implement appropriate technical and organizational safeguards and prohibit secondary use.
    Contributors must not submit personally identifiable health data or any health information about others without valid, documented consent.
    All shared scientific materials must be anonymized and compliant with data privacy standards.
    We strongly advise all suppliers, customers, and contributors not to upload or transmit health information unless strictly required and lawfully permitted.
    If individual health data is included in uploaded documents (e.g., medical fitness certifications, disability disclosures in resumes), we treat it in accordance with this Policy and ensure it is stored securely and accessed only by authorized personnel for necessary business or legal purposes.

  • You have rights regarding your Consumer Health Data, including:

    • Right to Know what Consumer Health Data we collect and who it is shared with
    • Right to Access your Consumer Health Data
    • Right to Delete Consumer Health Data we hold about you
    • Right to Withdraw Consent, which may also initiate a deletion request
    • Right to Non-Discrimination for exercising your rights
    • Right to Opt Out of automated decision-making or profiling related to your health, including our AI-driven recommendation tools
     
    Please note that exercising this right may limit your access to certain personalization features or product recommendations.

    We will verify your identity and respond within the timeframe required by law (typically 45 days).
    You may also file a complaint with your state’s attorney general if you are dissatisfied with our response.

  • We retain Consumer Health Data only as long as necessary to fulfill the purposes described in this policy or to comply with applicable laws.
    Afterward, the data will be securely deleted or anonymized.

  • If your data is processed outside your country of residence, we apply adequate safeguards such as standard contractual clauses to ensure lawful transfers.
    For users located in the EU/EEA or UK, we comply with the General Data Protection Regulation (GDPR) and use approved Standard Contractual Clauses (SCCs) or other appropriate safeguards to lawfully transfer health-related data across borders.

  • Weller & Co. does not knowingly collect Consumer Health Data from children under the age of 13.
    If such data is discovered without verified parental consent, it will be deleted promptly.
    Contributors are prohibited from including any health data about children under 13 unless verifiable parental consent has been obtained in accordance with applicable legal standards and Weller & Co. has authorized such publication.
    We advise all users, including job applicants and vendors, not to upload health data relating to minors unless specifically required by law and with proper parental or guardian authorization.
    Any such data will be deleted if received without verification.

  • Weller & Co.’s Site includes a Careers section where prospective candidates may upload resumes and learn about our company and roles.
    While we do not collect applications directly through the Site, resumes submitted for informational or networking purposes may be stored temporarily.
    These may contain personal or health-related data (e.g., disability status or medical accommodations).
    This information will only be accessed by authorized HR personnel and processed for recruitment-related purposes, in accordance with applicable employment and data privacy laws.
